Bad news on potentially prosecuting those responsible for torture in your name.

Courtesy of, among others, John McCain.

Here is the relevant part of the Detainee Treatment Act of 2005:

“It shall be a defense that such officer, employee, member of the Armed Forces, or other agent did not know that the practices were unlawful and a person of ordinary sense and understanding would not know the practices were unlawful.”

Someone want to explain to me how an ordinary person would not know that making another person think they were drowning, or leaving a person naked in a bare room for long periods of time, or threatening a person with dogs is illegal?
